Bankruptcy is a legal proceeding to help people who cannot pay their bills get a fresh financial start.   The right to file from bankruptcy is provided under federal law (U.S. Code Title 11) and all bankruptcy cases are heard in the United States Bankruptcy Court.  Filing bankruptcy prevents all of your creditors from collecting debts from you, at least until your debts are sorted out according to the law.

Bankruptcy can help you:

  • Remove the legal obligation to many, most, or all of your debts.  This is called a discharge of debts.  The discharge will normally include bills such as credit cards, medical debts and similar debts.

  • Stop foreclosure on your house and give you time to catch up on missed payments

  • Help you keep your car and other property or force the return of repossessed property.

  • Stop wage garnishment, debt collection, harassment, and similar creditor actions to collect a debt.

  • Restore or prevent shut-off of utility service.
